Examination of the functions of the sanctioning system, with particular regard to the various figures of deviance and to the penitentiary institutions, namely: the different interpretations of the evolution of the punitive systems, the social control, the psychological and anthropological foundations of the punishment, the relationship between morality and criminal law, the contrast between Classical Penal School and Positive School, the retributive theories, the contraposition between punishment and treatment, the abolitionist theories, the sociology of prison life, the 'total institutions', the processes of degradation of the defendants and the prisoners, the representation of deviance in the mass media, the transition from the welfare state to the 'penal state', the theories of child abuse, the Durkheimian sociology of punishment, the anomie, the Chicago school, the labeling theory, the critical criminology and the new criminological realism. The second part of the course will be devoted to examining the fundamentals of legal informatics and criminal law of information technology. In particular, will be examined the impact of new security technologies, both in terms of their offensive capacity and in terms of the protection of legal assets. The lectures will be integrated with seminars held by experts in the field.

In the first part the different legal-sociological theories about the functions of the punishing system will be introduced, with particular reference to the different kinds of deviance and penitentiary institutions. In particular will be analyzed in depth: the different interpretations of the evolution of punishing systems; social control; the psychological and anthropological foundations of punishment; the relationship between morality and criminal law; the opposition between the classical school and the positive school (Lombroso and Ferri); retribution, due process and deterrence theories; the opposition between punishment and offender’s treatment; abolitionist theories; the sociology of prison life; ‘total institutions’; the process of degradation of defendants and convicts; the representation of deviance in the media; the transition from the welfare state to the ‘penal state’; theories of juvenile deviance; Durkheim’s sociology of punishment: anomie; the Chicago school; the labelling theory; critical criminology and the new criminological realism. The second part of the course will be devoted to information technology law and legal informatics with special reference to cybercrime and cibersecurity. The lectures will be integrated with seminars in which some topics will be discussed with experts.

In the first part of the course the teacher will present the main legal-sociological theories on punishment, with a special focus on deviance and the penitentiary system. In the second part of the course basic theories of legal information technology will be discussed, with a special focus on new security technologies. Experts will be invited.
